"defamatory, derogatory" remarks against UP & Bihar : Rahul Gandhi Receive Court Summons

Congress Vice President Rahul Gandhi was on Tuesday issued summons by a local court on a petition filed by a city-based lawyer objecting to certain reported "defamatory, derogatory" remarks made by him about the natives of Uttar Pradesh and Bihar at an election rally nearly two years back.

Rahul as the then Indian Youth Congress chief, while kicking off party's UP election campaign in Phulpur on November 14, 2011 had reportedly said, "How long will you go and work as labour in Punjab and Delhi, how long will you beg (for work) in Maharashtra?."

The petitioner said, "That the above said statement of the defendant (case Shiv Murti Yadav versus Rahul Gandhi) is clearly defamatory, derogatory statement intending to cause irreparable loss to the image, reputation and prestige of the plaintiff and similarly situated persons."

Judicial Magistrate Jaswinder Singh, issued 'dasti' summons for September 19, "to Rahul Gandhi, General Secretary, AICC c/o President, AICC, 10 Janpath, New Delhi."

The "dasti summons" have been "forwarded to the Court of CMM, New Delhi, Patiala House, for service and return before the date fixed" as the summons issued earlier on

August 17 could not be served.

"Whereas the plaintiff/ petitioners has instituted the above case against you. You are hereby summoned to appear in this court in person or through your attorney on 19.9.2013, directed to produce on that day documents upon which you intend to rely in support of your defence," the summons said.

It further said, "Take notice that in default of your appearance on the day mentioned before the suit/application/ appeal will be heard, determined in your absence."

The petitioner had filed a case in December 2011, accusing him of hurting sentiments of people of the two states.

News : Absconding Principal Meena Devi Arrested, Bihar Mid-day meal tragedy

Eight days after the mid-day meal tragedy which claimed the lives of 23 children, police today arrested the absconding school principal and has begun interrogating her.

"We arrested her from Chhapra town," Saran district superintendent of police and head of the special investigation team Sujeet Kumar said.

Bihar Chief Minister Nitish Kumar confirmed the arrest of the principal, Meena Devi.

"The investigation is on. The principal of the school is in police custody. We will probe the incident from all possible angles," Kumar told reporters in Patna.

State Police chief Abhyanand who was present at the CM's press meet said the absconding principal of Dharmasati Gandaman primary school in Chhapra in Saran district has been arrested and she did not surrender.

He, however, refused to disclose the location from where she was arrested and other details saying these were matters of investigation.

Meena Devi was held even as a notice declaring her as a proclaimed offender was pasted at her Chhapra home.

The notice asked Meena Devi to present herself before the police immediately failing which the process of attachment of her property will start, the SP told PTI.

Earlier in the day, she had filed an anticipatory bail application in the court of CJM Chhapra which did not provide her any instant relief.

An FIR had been lodged against Meena Devi with Mashrakh police station in the mid-day meal case and she had been absconding since the incident on July 17 along with her husband, said to the supplier of the food material used on that day.

News : Bihar Meal Tragedy, The Headmistress forced the cook

Headmistress of an Indian school where 23 pupils died after eating a free lunch contaminated with pesticides forced a cook to ignore complaints and serve the suspect food, police have claimed.

Shortly after her instruction, the cook collapsed and, 90 minutes later, the first victim, Anshu Kumar, aged four-and-a-half, died on his way to hospital. Investigators believe that the mustard oil used in cooking the meal had been contaminated with poisonous organophosphate pesticides.

The scale of the tragedy provoked violent protests from parents and relations in Chappra, Bihar, one of India's poorest states, and anger throughout the country. Several parents buried the bodies of their children in front of the school in protest on Thursday.

"We decided to bury our children in front of the school building to remind the government that they died because of their negligence," said Madav Ram, whose 12-year-old son Rahul was among the victims.

"We also plan to raise a memorial in the memory of the dead children inside the school." The Midday Meal Scheme is the world's largest and serves free lunches to 120 million pupils throughout India. Many parents send their children to school primarily for the free meal, but there have been widespread complaints of substandard and rotten food.

Abhishek Sinha, a district magistrate, told The Daily Telegraph that he believed many of the children who ate the meal at Dharmashati-Gandaman primary school on Tuesday may have been saved had the headmistress, who is now on the run, tasted the food before it was served, as required under the scheme's rules.

He said an adult would have survived the tasting but the children, aged four to 10, were more vulnerable because of their low body weight. The head, identified as Meena Devi, had been in charge of buying the food for the scheme with government funds. Sujeet Kumar, a police superintendent, said the school's cook, Manju Devi, had warned the headmistress that the oil may have been contaminated after it began emitting a foul smell during cooking. "The headmistress said, 'Continue cooking and serve the food to the children'. There is certainly negligence on the part of the headmistress, whether criminal by design or carelessness, which is under investigation," he said. Bihar Children Deaths : Insecticide found on post-mortem, either in food or cooking oil!

It is a sad tale of over 20 children losing their lives and another two dozen or so falling sick after eating their free lunch at a primary school in Bihar. While the government mid-day meal scheme in schools is such an essential component to meet the nutrition needs of thousands of children across the country, this is clearly a case of downright negligence on part of the local administration that needs strict action. The photograph captures the despair that arises out of such an incident even as the camera holds its lens on a meal being served to a bunch of school children in Bodh Gaya.

Patna Medical College Hospital superintendent Amarkant Jha Amar on Thursday said post-mortem reports on the 22 children who died after eating mid-day meal at Chapra in Saran district of Bihar show that insecticide was either in the food or cooking oil.

Dr. Amar said results of the chemical analysis of the ingredients seized from the school were still pending on Thursday.

Dr. Amar also said the 25 children and a cook still being treated in the hospital are unlikely to suffer from any serious after effects of eating the food.

The Controversy

Massive protest has been carried out by different groups at Chhapra, a district in Bihar where 23 children died after having poisonous mid-day meal in a government school. The principal and other teachers were absconding, informed police on Thursday, July 18. It was suspected that the principal along with opposition party leaders allegedly had hatched the conspiracy against the kids targeting the ruling state government.

PK Shahi, the Education Minister in Bihar, informed that all grocery items used in mid-day meals were brought from a shop which is owned by Arjun Rai, husband of the school principal. Questioning Rai's alleged role in the "conspiracy", the minister also claimed that Rai belongs to an opposition party. Shahi also said that autopsies of the children revealed that organo-Phosphorous had been injected into the meal. Raising serious questions regarding the alleged conspiracy, the minister asserted, "All the food items used to be brought from his grocery shop. It is a matter of an inquiry how poison was used."
