Heroine Team Fights against static smoking tag

Heroine Production house has been not in good moods when the Ministry of Information and Broadcasting imposed a latest rule on the movie to have static 'no-smoking' messages to be displayed whenever a smoking scene was shown on screen, this is in addition to the 20-seconds long no smoking message from the leading cast or the person who smokes at the start, interval and the end credits of the movie.


The production house, UTV Software Communication, moved the court seeking quashing of the I&B ministry's August two letter imposing the condition on the filmmakers to display the "static" anti-smoking message during smoking scenes.


The petitioner production house sought the court to directed the CBFC to issue the certificate for the release of movie without the condition.

According to the petition, the I&B ministry has in its August two letter requested the CBFC to advise the filmmakers to ensure "a 20-second anti-smoking message as approved by Health Ministry with voice over of the actors who is seen smoking in the film to be displayed at the beginning and in middle (after interval) of the film."

In response to the petition from the makers, Issuing notices to the I&B Ministry, Health Ministry and Central Board of Film Certification (CBFC), Justice Rajiv Shakdher sought their responses by September 10. The movie is scheduled to be released on September 21 and if the makers do not make the changes, I&B has mentioned that they wont sanction the release.

The Ministry had issued a letter pursuant to its October 27, 2011 notification in terms of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply) rules.

The above conditions were already followed and this is when the new rules were sent out by the ministry to be imposed on the movie which has irked the producers.

We will wait to see what comes of the recent ruling and how this affects the movie.
